DMCA Policy
Ios New Emojis ("we," "us," or "our") respects the intellectual property rights of others and is committed to responding to any claims that content posted on our website or services infringes on the copyright of any person or entity. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable intellectual property laws.
This policy outlines the procedures for copyright holders to notify Ios New Emojis of alleged infringement and for users to file counter-notifications when their content has been removed due to a DMCA notice.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on or through Ios New Emojis infringes upon your copyrights, you may submit a written DMCA Notice of Infringement to our Designated Copyright Agent containing the following information (please consult your legal counsel or see 17 U.S.C. § 512(c)(3) to confirm these requirements):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide direct URLs if possible.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA Notice of Infringement, we will remove or disable access to the allegedly infringing material and will make reasonable efforts to notify the user who posted the material. We may also provide the user with your contact information so that they may communicate directly with you.
DMCA Counter-Notification Process
If you believe that your content was removed or disabled by mistake or misidentification, you have the right to submit a DMCA Counter-Notification. Your Counter-Notification must be a written communication provided to our Designated Copyright Agent and must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Ios New Emojis may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
Upon receipt of a valid Counter-Notification, we will promptly provide the complaining party with a copy thereof. If the complaining party does not inform us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our system within 10-14 business days, we may replace the removed material or cease disabling access to it. We will not be responsible for any damages incurred as a result of the content being re-posted.
